Para 3.28 - The statement 'flexibility will be exercised where viability and deliverability are critical factors' only seems to act as a 'get out clause'. From a water resources point of view, meeting levels 5 and 6 can be met without excessive costs or technology.

To encourage sustainable design and construction NSC should incorporate Site Waste Management Plan Regulations 2008 into their planning policies and requirements. You should also consider how you will implement the regulation of the relevant legislation through your own departments. This would also tie in with policy CS7 by helping to reduce waste arisings.

Greater flexibility needs to be incorporated within the wording of the policy. The requirements in items 2, 3 & 4 under this policy are demanding particularly in the light of the present economic circumstances. Viability is the key consideration if the scale of both economic and residential development required for this District is to be achieved and the wording should be amended accordingly.

PROPOSED CHANGES The deletion of Policy CS2 and it's rewriting to provide policies in compliance with PPS1 and the PCRSS. These changes should ensure that the: - Renewable energy targets reflect the PCRSS requirement of 10% and are supported by viability assessments and an appropriate evidence base; - Code level requirements should be set to reflect national standards due to likely changes to the Code for Sustainable Homes system; - Life Time Home standards are deleted.
