DM49 - Proposals for economic development within towns and defined settlements: To ensure consistency with adopted Core Strategy policy CS20 and proposed Sites and Policies Plan policy DM52, we recommend that the following sentence is added to the penultimate paragraph of policy DM49: 'Proposals for economic development of land and buildings used or last used as employment sites for economic use, will be looked on favourably'. DM50 - Allocated and safeguarded B1, B2 and B8 use class sites:

DM49 & DM50 - Proposals for jobs and growth The Council has noted the policy intentions here but, while positively supporting the aim to provide new jobs and to promote economic growth, we have concerns about the site allocation at Havyatt Business Park, Wrington, ref Schedule 2. We want to highlight the following wording in policy DM49 in relation to the objection made under policy DM50 below: 'Within the Service and Infill Villages proposals would, in addition to the above, need to be of a

Policy DM50 2.7 Land is proposed to be allocated for new business development broadly in accordance with Core Strategy Policy CS20. The Proposals Map and Schedule 2, sites for employment development, sets out the sites to be allocated and specifically safeguarded for these uses which includes the residual allocation carried over from replacement Local Plan - E22. 2.8 The site is allocated for employment purposes within the Replacement Local Plan (adopted March 2007), the end date of which

Policy DM50: Allocated and safeguarded B1, B2 and B8 use class sites This policy would seem to be inconsistent with the broad definition of 'economic development' set out in Annex 2 of the NPPF, with the Government commitment to securing economic growth set out in paragraphs 18-22 of the Framework, and with the soundness test for the Plan to be 'positively prepared' (para. 182). By restricting proposals on the allocated sites to uses within classes B1, B2 or B8 the Council is potentially dete

DM50&51-Employment Allocated employment sites adjacent to the Cross Rhyne, although not in the floodplain, it is important to consider suitable river access and/or channel improvements through these developments.

B.3.1 Employment, Site E24: Site E24 has been unsuccessfully designated for many years for employment use. Appropriate access to the site is restricted and it is badly served by highways. The site is also in close proximity to residential dwellings. The site has proved unattractive to most potential developers and employers. The lack of interest is despite considerable marketing. Developers are familiar with the opportunity and declined to make proposals. It is essential that this area is now

Objection to Policies DM 13, 20, 33, 34, 48,50, 51,71,72,73 and to SCHEDULEs 1 & 2 Reasoned justification The continued consultation in this Sites and Policies Plan on many policies including policy DM 13, 20, 33, 34, 48,50, 51,71,72,73 and SCHEDULEs 1 & 2 is inappropriate, following the decision of the High Court to remit strategic policies within the Core Strategy 2012. Until such time as the Council have addressed the matters referred to in Court Judgement, there are substantial elements of
