Objection to Policies DM 13, 20, 33, 34, 48,50, 51,71,72,73 and to SCHEDULEs 1 & 2

Reasoned justification

The continued consultation in this Sites and Policies Plan on many policies including policy DM 13, 20, 33, 34, 48,50, 51,71,72,73 and SCHEDULEs 1 & 2 is inappropriate, following the decision of the High Court to remit strategic policies within the Core Strategy 2012. Until such time as the Council have addressed the matters referred to in Court Judgement, there are substantial elements of the Core Strategy which are no longer adopted and therefore for legal purposes, cannot be relied upon by the Council in taking forward this Sites and Policies Plan.

Until such time as the Council have determined through due process:

the scale of future housing requirements for North Somerset and subsequently its distribution throughout the district,

subjected those proposals and policies to an adequate Sustainability Appraisal and a Habitats Regulations Assessment ,

a public consultation, an EiP, a finding of legal compliance and soundness by an Inspector

and its final adoption,

it cannot move forward with a sound Sites and Policies Plan in anticipation that there will be no change to the Core Strategy.

The NPPF is national policy and despite its adoption immediately prior to the formal adoption of the North Somerset Core Strategy in 2012, the Inspectors report and the Council have not had regard to the NPPF. Annex 1 Implementation, sets out clear statutory guidance for Councils for bringing the plans up to date. In the case of this Council, the Core Strategy is only partially adopted ( following the High Court decision) however the weight to be given to the rest of the plan is limited.

Therefore we object to the consultation at this stage and will request that this objection is duly made in respect of the above policies and schedules. Please acknowledge receipt of this objection.
